Immigration law changes

Many of you may have read that Homeland Security, through Social Security, will be trying to enforce the immigration laws. Some would assert that business is now being asked to enforce immigration laws.

The requirement is that if an employer hires someone, and the employee's information doesn't match Social Security's records, the employer will be given two to three months to make sure there is a match or be required to fire the employee. If an employer fails to take action, the employer could be fined up to $10,000.

This creates a significant liability for the employer because, if an employee is fired and it is determined that Social Security is wrong, the employer could be subject to wrongful termination claims.

At a meeting of the National Small Business Association, Tom Sullivan, the US Small Business Advocate, indicated that the Federal Government will not be going after businesses with fewer than 10 mismatches.
